Article 1 : General
YourTVLink and the yourtvlink.com website offer the installation of satellite systems, the sale of English & American television reception equipment via TV BOXes and subscription services to television channels.
The present General Terms and Conditions of Sale govern all sales of products and all services (installation, assistance, subscription, management, maintenance, repair and services) offered by YourTVLink and the yourtvlink.com site.
The natural or legal person acting as CUSTOMER and prevail over any other general terms of sale not accepted by YourTVLink.
YourTVLink reserves the right to modify the present General Conditions of Sale, the products and the prices offered at any time and without prior notice, with the obvious exception of orders in progress which retain their conditions valid on the date of validation of the order.
The present General Terms and Conditions of Sale are available to the customer on request in PDF format.
Article 2 : Validation of the order
When the client validates his order, he declares that he accepts the order and the entirety of these General Terms and Conditions fully and without reservation, of which he acknowledges having taken cognisance.
However, YourTVLink reserves the right to cancel any order from a client with whom there is a dispute relating to the payment of a previous order or if the financial transaction is conclusively of a fraudulent nature in view of the elements provided by the client.
Article 3 : Obligations of YourTVLink
YourTVLink undertakes, after acceptance of the client’s order, to sell and deliver the products ordered within the limits of available stocks or to carry out the service requested in accordance with these general conditions.
Article 4 : Customer obligations
The client undertakes to accept delivery of the products and services ordered and paid for by YourTVLink. If the delivery is made to a third party, the client must ensure that the person taking delivery accepts the present General Terms and Conditions of Sale in their entirety.
Article 5 : Product illustrations
The photographs appearing in the article sheets of the products visible on the site have no contractual value but serve to illustrate the descriptive text. YourTVLink rejects all responsibility in the event that a specific product does not conform in all respects to the photograph posted online, given the margin of error that may exist between the object itself and its photograph.
Article 6 : Validity of the offer and prices
Prices may vary during the year: the products ordered are invoiced at the price in force when the order is registered.
Article 7 : Payment
Orders are to be paid before dispatch or on receipt of invoice for clients with an account by the following means: by bank transfer or by cheque made payable to YourTVLink.
YourTVLink reserves the right to change and develop the means of payment offered on the site.
Article 8 : Products
Products are offered by YourTVLink within the limits of available stocks. Having established firm and stable relationships of trust with our suppliers in Europe and the United Kingdom, YourTVLink generally delivers within 5 to 7 working days, following payment, after configuration and preparation of the product.
Article 9 : Contribution to the cost of delivery
The cost of shipping is calculated according to the weight and size of the object, the shipping method and the country of destination.
Article 10 : Delivery
- The delivery of the ordered products is made to the address provided by the customer when ordering. If the delivery address is different from the billing address, the customer must specify the delivery address when ordering.
- The customer must also provide all information necessary for delivery. In the event of erroneous information having led to the impossibility of delivery, a second delivery may be made after return of the parcel to the service provider mandated by YourTVLink to dispatch the orders, but this may only be done in return for new delivery charges paid by the client.
- In case of non-acceptance of the delivery by the client, the client will be reimbursed the full amount of his order, including shipping costs. It is the client’s responsibility to contact YourTVLink to obtain reimbursement of the payment he or she has made, the refusal of delivery having to be notified in writing on the carrier’s delivery slip in order to justify the non-acceptance.
- In the event of significant delay or difficulty in locating the package, the client must contact YourTVLink which will open an investigation in order to locate the package that may have been lost by the carrier. No reimbursement of the client can therefore take place before the carrier has declared the package lost and has provided YourTVLink with a declaration of loss.
- The client may proceed to an examination of the physical condition of the package delivered by the carrier as well as an examination of its contents, in the presence of the delivery person. Any anomaly noted during this inspection must imperatively be the subject of handwritten reserves entered on the carrier’s delivery slip. These reservations must be explicit, dated and signed by the customer in order to avoid any dispute.
If the package shows external signs of damage, the customer must refuse the delivery after having written his reservations on the delivery slip.
The client and the carrier are entirely responsible for informing YourTVLink of the non-acceptance of the package, after which YourTVLink will contact the client to arrange for a new delivery of the order, it being understood that any damage caused will be at the carrier’s expense and in no case at that of the client.
In case of a package indicated as “delivered in conformity” by the carrier but which the client declares not to have received, the client must inform YourTVLink and also proceed himself to a complaint with the carrier’s complaint department.
Article 11 : Right of withdrawal
For distance sales of products, the customer has a withdrawal period allowing him/her to renounce his/her purchase within 14 days of delivery, in application of the provisions of Articles L 121-20 and L 121-20-1 of the Consumer Code. He must imperatively inform us beforehand of his intention to return the parcel within the framework of the exercise of his right of retraction by contacting us by e-mail via the Contact page of the site.
In the event that the client wishes to return the contents of his order within 14 days of the date of delivery, YourTVLink will proceed to reimburse the client or issue a credit note or proceed with an exchange (depending on what is agreed between the two parties) upon receipt of the products. The products concerned must then be returned to YourTVLink at the client’s expense and under his responsibility, at his expense to insure the transport, in perfect condition for resale, in their original packaging and showing no trace of shock or malfunction, it being understood that all equipment must be returned without having been used in any way by the client.
Subject to compliance with the preceding provisions, YourTVLink will reimburse the products ordered for the amount indicated on the order form, within 30 days of receipt of the products.
No reimbursement can be made if the products are not in their original packaging, which must be perfectly intact.
In the event that the client wishes to exercise his right of withdrawal within a period of 14 days on non-consumable equipment and that the said equipment has been used in any way, the reimbursement (or credit note or exchange) will take into account a minimum discount of 15% on the price of the new equipment depending on the condition in which it is received by YourTVLink.
Article 12 : Returns
In the event of an error on the part of YourTVLink (such as an article delivered in place of another or a defective article unfit for consumption or use), the goods will be exchanged or reimbursed within 30 days
In the specific case where an item of equipment malfunctions when it is put into service, the client has a period of 14 days from receipt of the goods to inform YourTVLink of the failure to put it into service.
After examining the situation, YourTVLink shall proceed with reimbursement or issue a credit note or proceed with an exchange (depending on what is agreed between the two parties) upon receipt of the defective equipment which must be returned in its original packaging.
Article 13 : Manufacturers' guarantees
The products are guaranteed by their manufacturers for the duration and according to the terms indicated on the description of the products. In the event of a defective product, the consumer must return it in accordance with the conditions set out in Article 12 of these general conditions.
No return will be possible beyond a period of 14 days from the date of receipt, the costs and risks associated with the return of the defective product remaining at the client’s expense.
YourTVLink cannot commit itself to any processing time for products under guarantee insofar as the after-sales service operations are carried out by a service centre approved by the manufacturer of the products concerned. The guarantee of defective products is subject to the full payment of their price by the customer.
Malfunctions caused by improper use of the product (such as poor maintenance or physical abuse) or by an external cause (such as a power surge or electrical short-circuit) shall not give rise to a guarantee. The provisions of this article shall not deprive the customer of the legal guarantee described in Article L 211-1 of the Consumer Code.
Article 14 : Force majeure
In the first instance, cases of force majeure will suspend the execution of the contract. If the cases of force majeure last longer than three months, the present contract will be terminated automatically, unless the parties agree otherwise. Expressly, the following are considered as cases of force majeure or fortuitous events, those usually retained by the jurisprudence of the French Courts and Tribunals total or partial strikes, internal or external to the company, block out, bad weather, epidemics, blockage of means of transport or supply for any reason whatsoever, earthquakes, fires, storms, floods, water damage, governmental or legal restrictions, legal or regulatory changes in forms of marketing, computer breakdowns, blockage of telecommunications and any other case beyond the express control of the parties preventing the normal performance of this agreement.
Article 15 : Data Protection Act
In accordance with the law of 6 January 1978 modified by the law of 6 August 2004, Internet users have the right to access and rectify personal data concerning them. This data is only provided for the purpose of delivering products ordered through the site, by fax, telephone or post. It is compulsory for the processing of their order and for any checks that may be carried out to combat fraud. If optional data is collected, the customer will be informed of this optional nature. The customer is advised that refusal to provide compulsory data will result in the impossibility of proceeding with the delivery of the products he/she would like to order.
The customer is also informed that in the context of the verification of the information provided in the order, the data may be passed on to third parties for the sole purpose of verification. All requests for clarification concerning personal data and/or the purpose of the processing set up, as well as the exercise of the rights of access, rectification and opposition shall be made by e-mail.
Article 16 : Reservation of ownership
The transfer of ownership of the products delivered to the customer only takes place after full payment of their price and its accessories: the risks of loss, theft or destruction remain the responsibility of the customer.
